Personal-use license terms for the free Phaeton home entitlement.
Effective date
These terms of service are effective as of 1 April 2026.
1. Scope
These terms govern the free personal-use license for Phaeton, a protocol bridge for EV chargers. By accepting these terms and claiming a home entitlement, you agree to be bound by them.
These terms apply to the personal / home license tier only. Commercial licensing is governed by separate agreements between Virtunet B.V. and its commercial partners.
2. License grant
Subject to these terms, Virtunet B.V. grants you a personal, non-exclusive, non-transferable (except as described in Section 5), royalty-free license to use Phaeton for non-commercial, personal or household purposes.
- One entitlement per verified home account.
- One active installation per entitlement at any time.
- The license is perpetual for runtime use — your licensed installation will continue to function regardless of whether an update entitlement is active.
3. License binding
Your license is bound to a specific installation through:
- An install ID — a randomly generated identifier unique to your installation.
- A device fingerprint — cryptographic hashes of stable device identifiers used to prevent unauthorized copying of the license to a different device.
The license file is cryptographically signed by Virtunet B.V. and verified locally by Phaeton at startup. Tampering with, forging, or redistributing license files is prohibited.
4. Restrictions
You may not:
- Use the personal license for any commercial, business, or revenue-generating purpose.
- Redistribute, sublicense, or share your license file with others.
- Attempt to reverse engineer, decompile, or derive the private signing key or licensing verification logic.
- Circumvent or interfere with the license verification, fingerprint binding, or activation mechanisms.
- Create multiple home accounts to obtain additional free entitlements beyond the one-per-account limit.
5. Transfers
You may transfer your entitlement to a different device under the following conditions:
- One self-service transfer is permitted per rolling 12-month period.
- Self-service transfer requires the previous installation to be deactivated first (or reachable for remote deactivation).
- If the previous device is no longer reachable (hardware failure), a support-assisted transfer may be requested.
- Your existing entitlement is reused for the new device — no new entitlement is created.
6. Connectivity and heartbeats
Online-activated installations send periodic heartbeats (approximately every 24 hours) to the licensing portal. Heartbeats are used for:
- Installation visibility in the portal overview.
- Stale-install and duplicate-use detection.
Heartbeat failure or temporary loss of internet connectivity will never disable your licensed Phaeton installation. A valid perpetual license continues to function regardless of heartbeat status.
Offline-activated installations do not send heartbeats.
7. Updates
The update entitlement may expire independently from the runtime license. When the update entitlement expires:
- Your installation continues to run without interruption.
- You will no longer receive software updates until the update entitlement is renewed.
8. Termination
This license remains in effect as long as you comply with these terms. Virtunet B.V. may terminate or suspend your license if you materially breach these terms, including but not limited to using the personal license commercially or attempting to circumvent licensing mechanisms.
Upon termination, you must cease using Phaeton and delete any license files in your possession.
9. Disclaimer of warranties
Phaeton is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
Virtunet B.V. does not warrant that Phaeton will be uninterrupted, error-free, or compatible with all hardware configurations or EV charger models.
10. Limitation of liability
To the maximum extent permitted by applicable law, Virtunet B.V. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of Phaeton under this personal-use license.
Nothing in these terms excludes or limits liability that cannot be excluded or limited under Dutch law.
11. Governing law and jurisdiction
These terms are governed by the laws of the Netherlands. Any disputes arising from or in connection with these terms shall be submitted to the competent court in the Netherlands.

13. Withdrawal right
The personal-use Phaeton license is provided as free digital content with no payment obligation. Under Dutch law (Art. 6:230p(g) BW), the statutory 14-day withdrawal right for distance contracts does not apply to contracts for the supply of digital content not on a physical medium when no payment obligation exists.
You may stop using the service and deactivate your installation at any time through the portal overview.
14. Changes to these terms
Virtunet B.V. may update these terms from time to time. We will notify you of material changes at least 30 days before they take effect by sending a notice to the email address associated with your portal account.
If you do not agree with a material change, you may terminate your use of the service before the change takes effect by deactivating your installation and ceasing use of the portal. Your perpetual runtime license for any already-activated installation remains valid regardless of whether you accept updated terms.
Non-material changes (corrections, clarifications, formatting) may be made without advance notice.
